Adjustment of Status, more commonly known as AOS, is a crucial process involved when an individual already present in the United States seeks to secure a green card or permanent resident status. AOS is a common recourse for those who have entered the United States on a variety of visas including a K1/K2 visa, non-immigrant visas (such as tourist or student visas), or under the provisions of the Visa Waiver Program. These individuals, after assessing their situation and prospects, opt for permanent residency in the US.
The AOS process is a fairly lengthy one and can span anywhere from 8 to 12 months depending on the processing speeds of the United States Citizenship and Immigration Services (USCIS) field office that holds jurisdiction over the applicant's place of residence. It is of utmost importance that during this length of time, the applicant stays within American borders.
Approximately eight to eleven months after filing, the applicant will be provided with a temporary employment authorization, a social security card, and an advanced parole - a provision for emergency international travel. These items will be sent via standard mail services.
Eligibility for AOS encompasses a variety of requirements: First and foremost, you need to be a US citizen or a holder of a green card. In addition, it's necessary to show that you possess the financial capacity to provide adequate support to your spouse or relative. Furthermore, the applicant's record must be clear of any charges or convictions concerning crimes involving moral turpitude. The beneficiary (your spouse/relative) should also have a clean slate, void of any criminal record or violation of any US immigration laws.
The AOS process involves careful application filing. For those who entered the US under the Visa Waiver Program or a non-immigrant visa, it is imperative to file an I-130 Petition for Alien Relative simultaneously with the AOS application.
