The K-1 Fiancée Visa is a U.S. immigration application designed to permit a foreign national to enter the U.S. to marry their U.S. citizen partner. The process in its entirety usually takes approximately 12 to 15 months. This duration, however, depends largely on the workload at the USCIS California Service Center and the U.S. Embassy/Consulate in the fiancé(e)'s home country.
Eligibility criteria require the petitioner to be a U.S. citizen who has physically met their fiancée within the previous two years. They must earn an income above the 100% threshold as established by the HHS poverty guidelines (refer to form I-864P) and bear no criminal history involving moral turpitude crimes or violations encompassed by the Adam Walsh Act (AWA). Also, it's essential that they have plans to marry within 90 days following their fiancée's arrival in the U.S. Any previous marriages must have been legally ended, with evidence provided as needed.
Following marriage, the couple must apply for an adjustment of status (commonly known as a "Green Card" application) via the USCIS. If the couple doesn't marry within the 90-day window as prescribed by the K-1 visa terms, the foreign fiancée may need to depart the U.S. prior to her I-94 travel document - expiration date.
